MorrowMark — Send Yourself Forward in Time

1. Acceptance of Terms

By accessing or using MorrowMark (“the Service”), you agree to be bound by these Terms of Service. MorrowMark is operated by Jeremiah Gutierrez (“we”, “us”, “our”). If you do not agree to these terms, do not use the Service.

2. Description of Service

MorrowMark is a digital legacy platform that allows users to capture personal stories, values, and messages, and schedule AI-generated messages to designated family members on birthdays, milestones, and life events. The Service uses artificial intelligence to generate message content based on user-provided vault entries.

3. Account Registration

You must provide a valid email address and create a password to use the Service. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account. You may designate a trustee to manage your account on your behalf.

4. User Content

You retain ownership of all content you submit to MorrowMark (“Vault Entries”), including stories, values, advice, and other personal content. By submitting content, you grant us a limited license to store, process, and use that content solely for the purpose of providing the Service — including generating AI messages in your voice. We will never sell your content or use it for purposes unrelated to the Service.

5. AI-Generated Content

Messages generated by MorrowMark are created using artificial intelligence based on your vault entries. While we strive for accuracy and authenticity, AI-generated content may not perfectly represent your voice or intentions. You and your designated trustee are encouraged to review generated messages. We are not liable for any misrepresentation in AI-generated content.

6. Trustee Designation

You may designate a trustee and backup trustee to manage your MorrowMark account. The trustee will have access to manage recipients, review messages, and maintain your vault. You are responsible for choosing a trustee you trust. MorrowMark provides tools for trustee succession but is not a legal instrument — consult an attorney for estate planning integration.

7. Service Availability

MorrowMark is provided “as is” and “as available.” We make reasonable efforts to maintain the Service but do not guarantee uninterrupted availability. We are not liable for any failure to deliver a scheduled message due to technical issues, third-party service failures, or circumstances beyond our control.

8. Data Portability

You may export your vault entries and message history at any time through the Service dashboard. If you choose to close your account, we will provide a reasonable period to export your data before deletion.

9. Termination

You may close your account at any time. We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior. Upon termination, scheduled but undelivered messages will not be sent.
